Notice is hereby given to all residents in the Southold Park District that the boat slips at the Young’s Avenue Park will again be available in 2011. Only one application will be accepted per household. The 2011 fee for use of the slips will be $25.00 per foot and the season will run from May 1 to Nov. 1, 2011. The following boat size restrictions apply: Boats will be limited to 22 feet and under in length with an 8 foot and under beam. All applications must be submitted in writing stating the following information:
Applicant’s name, street address, mailing address and telephone number along with a description of craft including length, beam, draft, color and NYS ID number. Applicant must also submit a filing fee in the form of a check or money order in the amount of $100.00 made payable to the Southold Park District which will be applied to the slip fee if the applicant is a lottery winner or will be returned if the applicant is a non-winner. Filing fees for lottery winners who do not use the winning slips will be retained by the Southold Park District.

The Orient Mosquito District will conduct a mosquito control program in the Village of Orient from May 1, 2010, to October 31, 2010.

I. PESTICIDES USED FOR MOSQUITO CONTROL:

The following pesticides are used by the Orient Mosquito District in its mosquito control program. These pesticides are registered by the United Stated Environmental Protection Agency (EPA) and the New York State Department of Environmental Conservation (DEC).

Larvicides (Ground Application)

ALTOSID BRIQUETS (EPA REG. NO. 2724-375 8.62% METHOPRENE). The EPA Toxicity Category Signal Word for this pesticide is CAUTION. Keep out of reach of children. Causes moderate eye irritation. Harmful if absorbed through skin. Avoid contact with skin, eyes or clothing. Wash thoroughly with soap and water after handling and before eating, drinking, chewing gum, or using tobacco. Remove and wash contaminated clothing before reuse. Do not apply to known fish habitats. Do not contaminate water when disposing of unused product.

VECTOBAC-G (EPA Reg. No. 73049-10) 0.92% BTI. The EPA Toxicity Category Signal Word for this pesticide is CAUTION. Keep out of reach of children. Causes moderate eye irritation. Avoid contact with skin, eyes or clothing. Wash thoroughly with soap and water after handling. Do not contaminate water when cleaning equipment or disposing of equipment washwaters. Do not apply directly to treated, finished drinking water reservoirs or drinking water receptacles when the water is intended for human consumption.

VECTOLEX-CG (EPA Reg. No. 73049-20) 7.5% Bacillus sphaericus. The EPA Toxicity Category Signal Word for this pesticide is CAUTION. Keep out of reach of children. Harmful if absorbed through skin. Causes moderate eye irritation. Avoid contact with skin, eyes or clothing. Wash thoroughly with soap and water after handling. Do not contaminate water when disposing of equipment washwaters or rinsate. Do not apply directly to treated, finished drinking water reservoirs or drinking water receptacles when the water is intended for human consumption.

ALTOSID LIQUID LARVICIDE (EPA Reg. No. 2724-392) Methoprene (Isopropyl) (2E, 4E,TS) “METHOXY-3.7” “TRIMETHYL-2.4, DODECADIENCATE) 5%. The EPA Toxicity Category Signal Word for this pesticide is CAUTION. Keep out of reach of children. Harmful if absorbed through skin. Causes moderate eye irritation. Adulticides (Ground Application)

SCOURGE (EPA Reg. No. 432-716) 4.14% Resmethrin-The EPA Toxicity Category Signal Word for this pesticide is CAUTION. Keep out of reach of children. Harmful if swallowed or absorbed through skin. Avoid contact with skin, eyes or clothing. Wash thoroughly with soap and water after handling. This pesticide is highly toxic to fish. For terrestrial uses, do not apply directly to water, to areas where surface water is present or to intertidal areas below the mean high water mark. Drift and runoff from treated sites may be hazardous to fish in adjacent waters.

II. SYMPTOMS OF PESTICIDE POISONING INCLUDE: Blurred vision; Dizziness; Vomiting; Headaches; Itching or Rash; Irritation of Eyes, Skin or throat; Chest Pains; or Excessive Sweating.

III. PESTICIDE APPLICATION WILL BE MADE TO THE FOLLOWING AREAS ON THE SCHEDULE PROVIDED BELOW.

WEEKLY GROUND PESTICIDE APPLICATIONS FOR LARVAL CONTROL:

Will be applied by ground application once a week, if needed, to mosquito sites in approximately 600 salt marsh acres bordering Gardiners Bay in the Village of Orient from Peters Neck to Orient State Park and north to the Main Road as well as fresh water ponds and catch basins in the Orient Mosquito District.

WEEKLY GROUND APPLICATION FOR ADULT MOSQUITO CONTROL:

SCOURGE will be applied by ground application equipment (portable or truck mounted ultra low equipment) throughout ORIENT from May 1 to October 31 as requested or as required.

IV. BEEKEEPERS SHOULD NOTIFY THE ORIENT MOSQUITO DISTRICT AT THE ADDRESS BELOW OF THE LOCATION OF ALL OF THEIR HIVES.

The Board of Education of the Mattituck-Cutchogue Union Free School District, Suffolk County, New York, HEREBY GIVES NOTICE that a special meeting of the qualified voters residing in the Mattituck-Laurel Library District (which lies within the boundaries of said School District) will be held at the Mattituck-Laurel Library, Main Road, Mattituck, New York, in said School District, on Tuesday, September 28, 2010, at 10:00 a.m., prevailing time, for the purpose of voting upon the proposition hereinafter set forth. Shall the Board of Education of the Mattituck-Cutchogue Union Free School District be authorized to increase the approved appropriation of $1,010,144.00 for the year 2010 to $1,049,436.00 for the year 2011 for the benefit of the Mattituck-Laurel Library District which lies within the boundaries of the School District? [This would increase the total appropriation for the Mattituck-Laurel Library to $1,194,736.00, as the sum of $145,300.00 is added to the annual appropriation (the 12th of 20 previously approved annual installments) for payment of financing the construction of an addition and improvements to the Mattituck-Laurel Library Building.]

NOTICE IS ALSO GIVEN that the qualified voters will elect two (2) members of the Board of Trustees for three (3) year terms commencing November 9, 2010, and expiring November 12, 2013.

NOTICE IS ALSO GIVEN that petitions nominating a candidate for the office of Member of the Board of Trustees must be filed at the Mattituck-Laurel Library, Main Road, Mattituck, New York, between the hours of 10:00 a.m. and 5:00 p.m., prevailing time, not later than August 24, 2010. BE IT ENACTED by the Town Board of the Town of Southold as follows:

I. Purpose.

The purpose of this Local Law is to amend ¬ß280-105, “height of fences, walls and berms” to allow for deer fencing in residential and non-residential zones to protect the health, safety and welfare of Town residents, business owners and their property from injury and damage due to the growth of the population of deer within the Town.

II. Chapter 280 of the Code of the Town of Southold is hereby amended as follows:

§ 280-105. Height of fences, walls and berms.

Fences, walls or berms may be erected and maintained, subject to the following height limitations:

A. When located in the front yard of residential zones, the same shall not exceed four feet in height when located in the front yard of nonresidential zones, the same shall not exceed six feet in height.

B. When located in or along side and rear yards, the same shall not exceed 6 1/2 feet in height.

C. In residential and non-residential zones, except properties/parcels engaged in bona fide agricultural production, the installation of a deer exclusion fence may be permitted by obtaining a building permit issued by the Building Inspector, subject to the following criteria:

1. When located in or along side and rear yards, the height of the deer exclusion fence shall not exceed eight feet.

2. Specifications for construction of deer exclusion fences:

(i) Fencing Fabric: high-tensile, woven wire fence fabric with graduated opening;

(ii) Spacing Between Posts: 20 feet

3. Deer fencing is prohibited in or along the front yard of any property.

III. SEVERABILITY

If any clause, sentence, paragraph, section, or part of this Local Law shall be adjudged by any court of competent jurisdiction to be invalid, the judgment shall not affect the validity of this law as a whole or any part thereof other than the part so decided to be unconstitutional or invalid.

IV. EFFECTIVE DATE

This Local Law shall take effect immediately upon filing with the Secretary of State as provided by law.

A Local Law entitled, “A Local Law in relation to the Prevention and Control of Noise Pollution in the Town of Southold”.

BE IT ENACTED by the Town Board of the Town of Southold as follows:

I. A new Chapter 200 of the Code of the Town of Southold is hereby adopted as follows:

¬ß200-1. Title. This law shall be known as the “Prevention and Control of Noise Pollution Law of Southold Town.”

§200-2. Purpose. The gentle pace of life in the Town of Southold has traditionally provided a respite from the noise and turmoil which has become an integral part of life in the city and suburbs and which has even encroached into many resort areas on the East End. Crafting of regulations that are uniquely appropriate for the Town of Southold are aimed to protect this rural, almost nostalgic way of life while providing an atmosphere for businesses to flourish. The existence of unreasonably loud, unnecessary disturbing or unusual noise within the Town has become an increasingly, significant problem during recent years. Such noise pollution which is prolonged, unusual or unnatural in its time, place and use is harmful to the peace, welfare, comfort, safety, convenience, good order and prosperity of the inhabitants of the Town of Southold. It is the public policy and findings of the Town Board that every person is entitled to noise levels that are not detrimental to life, health and the enjoyment of his or her property. The provisions and prohibitions hereinafter enacted are in pursuance of this policy and these findings and for the purpose of protecting and promoting the public health, comfort, convenience, peace, safety, welfare and prosperity of the Town of Southold and its inhabitants.

§200-3. Statutory authorization. This chapter is enacted pursuant to § 10 of the Municipal Home Rule Law to promote the public health, safety and general welfare of Town citizens through regulations intended to govern noise pollution within the entire Town.

§200-4. Definitions. As used in this Chapter, the following terms shall have their meanings indicated.

AIRBORNE SOUND – Sound that reached the point of interest by propagation through the air.

AMPLIFIED SOUND – Sound which has its volume increased by electronic means.

CHARITABLE EVENT – An event whose sole purpose is to raise money for a specific charity or non-profit organization.

COMMERCIAL SERVICE EQUIPMENT – All engine-powered or motor-powered equipment intended for infrequent service work in inhabited areas, typically requiring commercial or skilled operators. Examples of commercial service equipment are chain saws, log chippers, paving rollers, etc.

CONSTRUCTION DEVICE – Any powered device or equipment designed and intended for use in construction. Examples of construction devices are air compressors, bulldozers, backhoes, trucks, shovels, derricks and cranes.

dB(A) – The A-weighted sound level in decibels, as measured by a general-purpose sound-level meter complying with the provisions of the American National Standards Institute specifications for sound-level meters, properly calibrated and operated on the A-weighing network.

DECIBEL (“dB”) – The unit for measuring the volume of a sound based upon the pressure level of a sound. For the purpose of this chapter, the standard reference pressure stated herein will be used to assure a consistent and standard reference for measuring sound.

HOMEOWNER’S LIGHT RESIDENTIAL OUTDOOR EQUIPMENT – All engine-powered or motor-powered garden or maintenance tools intended for repetitive use in residential areas, typically capable of being used by a homeowner. Examples of homeowner’s light residential outdoor equipment are lawn mowers, garden tools, riding tractors, snowblowers, snowplows, etc.

NOISE POLLUTION – Airborne or amplified sound which:

A. Causes temporary or permanent hearing loss in persons exposed; or

B. Is otherwise injurious, or tends to be, on the basis of current information injurious to the public health or welfare; or

C. Disturbs a reasonable person of normal sensitivities;

D. Exceeds standards or restrictions established herein; or

E. Interferes with the comfortable enjoyment of life and property or the conduct of business. The following are deemed to interfere with the comfortable enjoyment of life and property or the conduct of business:

1. Yelling or shouting at any time that disturbs the quiet, comfort or repose of person or persons residing or occupying an adjacent or neighboring property.

2. The using of, operating of or permitting to be played, used or operated, any radio, receiving set, musical instrument, phonograph, television set or other machine or device for the producing or reproducing of airborne or amplified sound in such a manner as to disturb the peace, quiet and comfort of the person or persons residing or occupying an adjacent or neighboring property.

PERSON – An individual, association, firm, syndicate, company, trust, corporation, department, bureau or agency or any other entity recognized by law as the subject of rights and duties

SOUND-LEVEL METER – An instrument for the measurement of noise and sound levels including a microphone, amplifier, an output meter and frequency weighting networks which comply with standards established by the American National Standards Institute (ANSI) specifications for sound-level meters.

§ 200-5. General prohibition. No person or persons owning leasing or controlling the operation of any source of noise on any lot or structure within the Town shall permit the establishment of a condition of noise pollution. Except as provided in §200-6, the use of amplifiers, speaker or other machines or devices capable of reproducing amplified or airborne sound from the premises, dwelling or building within the Town shall be considered noise pollution and shall be prohibited at all times.

§ 200-6. Standards. No person shall create or cause to be emitted any noise pollution which when measured at or beyond any lot line of the property on which such noise pollution is being generated, exceeds the following standards:

A. Sunday through Thursday: (i) from 7:00 a.m. to 7:00 p.m. airborne or amplified sound in excess of 65 dBA; and (ii) from 7:00 p.m. to 7:00 a.m. airborne or amplified sound in excess of 50 dBA.

B. Friday and Saturday: (i) from 7:00 a.m. to 10:00 p.m. airborne or amplified sound in excess of 65 dBA; and (ii) from 10:00 p.m. to 7:00 a.m. airborne or amplified sound in excess of 50 dBA.

§ 200-7. Exceptions.

A. The provisions of §200-5 and §200-6 shall not apply to the following:

1. The intermittent or occasional use between 7:00 a.m. through 7:00 p.m. of homeowner’s light residential outdoor equipment with mufflers or commercial service equipment, provided that such activities and such equipment and their use comply with the other provisions hereof.

2. Construction activities between 7:00 a.m. through 7:00 p.m. and the associated use of construction devices or the noise produced thereby, provided that such activities and such equipment and their use comply with the other provisions hereof.

3. Noise from agricultural equipment.

4. Noise from church bells or chimes used.

5. Noise from snowblowers, snowthrowers and snowplows when operated with a muffler for the purpose of snow removal.

6. Non-amplified noise generated from lawful athletic or recreational activities, events, or facilities.

7. Non-amplified noise-organized activities sponsored by any school district, private school or fire district or department within the Town of Southold.

8. Noise from municipally sponsored celebrations or events.

9. Noise from lawful fireworks displays, parades, and other charitable and special events held in accordance with all pertinent provisions of the Southold Town Code.

10. Noncommercial public speaking or public assembly activities conducted on any public space or public right-of-way.

11. Emergency construction or repair work.

12. Noise from the activities of any fire department, ambulance squad or similar emergency or rescue organization in carrying out their official duties.

13. Noncommercial amplified sound that does not exceed the noise standard established in §200-6 of this chapter.

14. Emergency stationary and mobile signal devices.

15. Audible exterior burglar alarms in operation for 15 minutes or less.

§ 200 Р8. Enforcement. The provisions of this chapter shall be administered and enforced by the Southold Town Police Department and the Southold Town Office of Code Enforcement.

§ 200- 9. Penalties for offenses.

A. Any person who shall violate the provisions of this chapter shall be guilty of a violation punishable by a fine not exceeding $500; and upon conviction of a third or subsequent offense within 18 months, punishable by a fine not exceeding $5,000. If such violation is of a continuing nature, each one hour period of violation of any provision of this chapter shall constitute an additional, separate and distinct offense,

B. In addition to any other remedy provided by law, the Town may bring an injunction proceeding to enforce this chapter.

II. SEVERABILITY

If any clause, sentence, paragraph, section, or part of this Local Law shall be adjudged by any court of competent jurisdiction to be invalid, the judgment shall not affect the validity of this law as a whole or any part thereof other than the part so decided to be unconstitutional or invalid.

The Orient Mosquito District will conduct a mosquito control program in the Village of Orient from May 1, 2010, to October 31, 2010.

I. PESTICIDES USED FOR MOSQUITO CONTROL:

The following pesticides are used by the Orient Mosquito District in its mosquito control program. These pesticides are registered by the United Stated Environmental Protection Agency (EPA) and the New York State Department of Environmental Conservation (DEC).

Larvicides (Ground Application)

ALTOSID BRIQUETS (EPA REG. NO. 2724-375 8.62% METHOPRENE). The EPA Toxicity Category Signal Word for this pesticide is CAUTION. Keep out of reach of children. Causes moderate eye irritation. Harmful if absorbed through skin. Avoid contact with skin, eyes or clothing. Wash thoroughly with soap and water after handling and before eating, drinking, chewing gum, or using tobacco. Remove and wash contaminated clothing before reuse. Do not apply to known fish habitats. Do not contaminate water when disposing of unused product.

VECTOBAC-G (EPA Reg. No. 73049-10) 0.92% BTI. The EPA Toxicity Category Signal Word for this pesticide is CAUTION. Keep out of reach of children. Causes moderate eye irritation. Avoid contact with skin, eyes or clothing. Wash thoroughly with soap and water after handling. Do not contaminate water when cleaning equipment or disposing of equipment washwaters. Do not apply directly to treated, finished drinking water reservoirs or drinking water receptacles when the water is intended for human consumption.

VECTOLEX-CG (EPA Reg. No. 73049-20) 7.5% Bacillus sphaericus. The EPA Toxicity Category Signal Word for this pesticide is CAUTION. Keep out of reach of children. Harmful if absorbed through skin. Causes moderate eye irritation. Avoid contact with skin, eyes or clothing. Wash thoroughly with soap and water after handling. Do not contaminate water when disposing of equipment washwaters or rinsate. Do not apply directly to treated, finished drinking water reservoirs or drinking water receptacles when the water is intended for human consumption.

ALTOSID LIQUID LARVICIDE (EPA Reg. No. 2724-392) Methoprene (Isopropyl) (2E, 4E,TS) “METHOXY-3.7” “TRIMETHYL-2.4, DODECADIENCATE) 5%. The EPA Toxicity Category Signal Word for this pesticide is CAUTION. Keep out of reach of children. Harmful if absorbed through skin. Causes moderate eye irritation. Avoid contact with eyes or clothing. Wash thoroughly with soap and water after handling. Do not contaminate water when disposing of equipment washwaters or rinsate.

Adulticides (Ground Application)

SCOURGE (EPA Reg. No. 432-716) 4.14% Resmethrin-The EPA Toxicity Category Signal Word for this pesticide is CAUTION. Keep out of reach of children. Harmful if swallowed or absorbed through skin. Avoid contact with skin, eyes or clothing. Wash thoroughly with soap and water after handling. This pesticide is highly toxic to fish. For terrestrial uses, do not apply directly to water, to areas where surface water is present or to intertidal areas below the mean high water mark. Drift and runoff from treated sites may be hazardous to fish in adjacent waters.

II. SYMPTOMS OF PESTICIDE POISONING INCLUDE: Blurred vision; Dizziness; Vomiting; Headaches; Itching or Rash; Irritation of Eyes, Skin or throat; Chest Pains; or Excessive Sweating.

III. PESTICIDE APPLICATION WILL BE MADE TO THE FOLLOWING AREAS ON THE SCHEDULE PROVIDED BELOW.

WEEKLY GROUND PESTICIDE APPLICATIONS FOR LARVAL CONTROL:

Will be applied by ground application once a week, if needed, to mosquito sites in approximately 600 salt marsh acres bordering Gardiners Bay in the Village of Orient from Peters Neck to Orient State Park and north to the Main Road as well as fresh water ponds and catch basins in the Orient Mosquito District.

WEEKLY GROUND APPLICATION FOR ADULT MOSQUITO CONTROL:

SCOURGE will be applied by ground application equipment (portable or truck mounted ultra low equipment) throughout ORIENT from May 1 to October 31 as requested or as required.

IV. BEEKEEPERS SHOULD NOTIFY THE ORIENT MOSQUITO DISTRICT AT THE ADDRESS BELOW OF THE LOCATION OF ALL OF THEIR HIVES.

Project Description:

The Department has prepared a draft permit and has made a tentative determination to approve this application for an Air State Facility permit pursuant to Article 19 (Air Pollution Control) of the Environmental Conservation Law (ECL). The US Department of Homeland Security operates the Plum Island Animal Disease Center as a diagnostic and research facility for exotic veterinary pathogens.

The facility contains three modular controlled-air incinerators, which dispose of waste generated within the biological containment. The east and orient incinerators are operated as crematories. Infectious waste will be fed to a crematory at no more than 5% of the total permitted hourly charging rate.

The west incinerator, which was earlier burning treated regulated medical waste from the exit autoclave in addition to paper, plastic, wood and food waste generated within the biological containment has been converted back into a crematory.

The facility operates three distillate oil-fired boilers. Four older boilers have been decommissioned. The facility’s potential to emit (PTE) oxides of nitrogen (NOx) exceeds the major facility threshold of 25 tons per year (TPY). The proposed State Facility Permit caps NOx emissions to less than 22.5 TPY by limiting fuel (#2 fuel oil) use to a maximum of 1,000,000 gallons per year. By accepting these state and federally enforceable limits on fuel usage the facility will cap the oxides of nitrogen emissions below the Title V threshold and the facility will not be subject to the provisions of the Title V operating permit program.

Three new diesel emergency generators have been commissioned. These emergency generators are used less than 500 hours per year, which makes them exempt.

Six small exempt remote heating units provide comfort heating to some buildings. The facility also has twelve exempt fuel oil, diesel fuel and gasoline storage tanks and dispensing units.

The application and the draft permit are available for review at the Region One office in Stony Brook. Persons wishing to inspect the files should contact the DEC representative listed below prior to visiting the office. The facility is located off the eastern tip of the North Fork of Long Island, in the Town of Southold, Suffolk County.

Availability of Application Documents: Filed application documents, and Department draft permits where applicable, are available for inspection during normal business hours at the address of the contact person. To ensure timely service at the time of inspection, it is recommended that an appointment be made with the contact person.

State Environmental Quality Review (SEQR) Determination: Project is not subject to SEQR because it is a Type II action.

SEQR Lead Agency: None Designated

State Historic Preservation Act (SHPA) Determination: The proposed activity is not subject to review in accordance with SHPA. The permit type is exempt or the activity is being reviewed n accordance with federal historic preservation regulations.

The Board of Fire Commissioners of the Orient Fire District, are requesting all interested parties to provide “Asphalt Driveway and Parking Lot Crack and Pavement Sealer” at the Orient Fire District property, located at 23300 Main Road (Route 25), Orient, New York. All bids will be accepted until 7:30 p.m., September 21, 2010, at which time and place, bids will be publicly opened and read aloud for providing the Orient Fire District with driveway and parking lot top coat and sealant.

The Orient Mosquito District will conduct a mosquito control program in the Village of Orient from May 1, 2010, to October 31, 2010.

I. PESTICIDES USED FOR MOSQUITO CONTROL:

The following pesticides are used by the Orient Mosquito District in its mosquito control program. These pesticides are registered by the United Stated Environmental Protection Agency (EPA) and the New York State Department of Environmental Conservation (DEC).

Larvicides (Ground Application)

ALTOSID BRIQUETS (EPA REG. NO. 2724-375 8.62% METHOPRENE). The EPA Toxicity Category Signal Word for this pesticide is CAUTION. Keep out of reach of children. Causes moderate eye irritation. Harmful if absorbed through skin. Avoid contact with skin, eyes or clothing. Wash thoroughly with soap and water after handling and before eating, drinking, chewing gum, or using tobacco. Remove and wash contaminated clothing before reuse. Do not apply to known fish habitats. Do not contaminate water when disposing of unused product.

VECTOBAC-G (EPA Reg. No. 73049-10) 0.92% BTI. The EPA Toxicity Category Signal Word for this pesticide is CAUTION. Keep out of reach of children. Causes moderate eye irritation. Avoid contact with skin, eyes or clothing. Wash thoroughly with soap and water after handling. Do not contaminate water when cleaning equipment or disposing of equipment washwaters. Do not apply directly to treated, finished drinking water reservoirs or drinking water receptacles when the water is intended for human consumption.

VECTOLEX-CG (EPA Reg. No. 73049-20) 7.5% Bacillus sphaericus. The EPA Toxicity Category Signal Word for this pesticide is CAUTION. Keep out of reach of children. Harmful if absorbed through skin. Causes moderate eye irritation. Avoid contact with skin, eyes or clothing. Wash thoroughly with soap and water after handling. Do not contaminate water when disposing of equipment washwaters or rinsate. Do not apply directly to treated, finished drinking water reservoirs or drinking water receptacles when the water is intended for human consumption.

ALTOSID LIQUID LARVICIDE (EPA Reg. No. 2724-392) Methoprene (Isopropyl) (2E, 4E,TS) “METHOXY-3.7” “TRIMETHYL-2.4, DODECADIENCATE) 5%. The EPA Toxicity Category Signal Word for this pesticide is CAUTION. Keep out of reach of children. Harmful if absorbed through skin. Causes moderate eye irritation. Avoid contact with eyes or clothing. Wash thoroughly with soap and water after handling. Do not contaminate water when disposing of equipment washwaters or rinsate.

Adulticides (Ground Application)

SCOURGE (EPA Reg. No. 432-716) 4.14% Resmethrin-The EPA Toxicity Category Signal Word for this pesticide is CAUTION. Keep out of reach of children. Harmful if swallowed or absorbed through skin. Avoid contact with skin, eyes or clothing. Wash thoroughly with soap and water after handling. This pesticide is highly toxic to fish. For terrestrial uses, do not apply directly to water, to areas where surface water is present or to intertidal areas below the mean high water mark. Drift and runoff from treated sites may be hazardous to fish in adjacent waters.

II. SYMPTOMS OF PESTICIDE POISONING INCLUDE: Blurred vision; Dizziness; Vomiting; Headaches; Itching or Rash; Irritation of Eyes, Skin or throat; Chest Pains; or Excessive Sweating.

III. PESTICIDE APPLICATION WILL BE MADE TO THE FOLLOWING AREAS ON THE SCHEDULE PROVIDED BELOW.

WEEKLY GROUND PESTICIDE APPLICATIONS FOR LARVAL CONTROL:

Will be applied by ground application once a week, if needed, to mosquito sites in approximately 600 salt marsh acres bordering Gardiners Bay in the Village of Orient from Peters Neck to Orient State Park and north to the Main Road as well as fresh water ponds and catch basins in the Orient Mosquito District.

WEEKLY GROUND APPLICATION FOR ADULT MOSQUITO CONTROL:

SCOURGE will be applied by ground application equipment (portable or truck mounted ultra low equipment) throughout ORIENT from May 1 to October 31 as requested or as required.

IV. BEEKEEPERS SHOULD NOTIFY THE ORIENT MOSQUITO DISTRICT AT THE ADDRESS BELOW OF THE LOCATION OF ALL OF THEIR HIVES.

V. FURTHER PESTICIDE AND APPLICATION INFORMATION IS AVAILABLE FROM ORIENT MOSQUITO DISTRICT.

The property is located in the A-C zoning district and is on the southerly side of Wickham Avenue, approximately 963.50 feet from the southwesterly intersection of County Road 48 and Wickham Avenue in Mattituck, New York. The proposed acquisition is for a development rights easement on a part of the property consisting of approximately 8.26± acres (subject to survey) of the 10.1± acre parcel.

The exact area of the acquisition is subject to a Town-provided survey acceptable to the Land Preservation Committee and the landowner. The purchase price is $63,000 (sixty-three thousand dollars) per buildable acre for the 8.26± acre easement plus acquisition costs.

The property is listed on the Town’s Community Preservation Project Plan as property that should be preserved due to its agricultural value.

NOTICE IS HEREBY GIVEN that sealed bids will be received by the Board of Education of the Mattituck-Cutchogue Union Free School District at the Office of the District Clerk located in the Central Administration Office, 385 Depot Lane, Cutchogue, New York, until 11:05 a.m., prevailing time, August 19, 2010, at which time and place they will be publicly opened and read for:

The Board of Education reserves the right to reject any and all bids and to waive any informality as the interest of the School District may require.

LEGAL NOTICE

WHEREAS, there has been presented to the Town Board of the Town of Southold, Suffolk County, New York, on the 27th day of July 2010, a Local Law entitled “A Local Law to Adopt the 2010 Retirement Incentive Program, Part B”.

RESOLVED that the Town Board of the Town of Southold will hold a public hearing on the aforesaid Local Law at the Southold Town Hall, 53095 Main Road, Southold, New York, on the 24th day of August 2010 at 4:40 p.m. at which time all interested persons will be given an opportunity to be heard.

The proposed Local Law entitled, “A Local Law to Adopt the 2010 Retirement Incentive Program, Part B” reads as follows:

A Local Law entitled, “A Local Law to Adopt the 2010 Retirement Incentive Program, Part B”.

BE IT ENACTED by the Town Board of the Town of Southold as follows:

I. Purpose.

This local law is being enacted in accordance with §10 of the Municipal Home Rule Law and pursuant to Chapter 105 of the Laws of 2010 for the purpose of making the 2010 Retirement Incentive Part B available to employees of the Town of Southold.

II. Part B – Chapter 105, Laws of 2010.

1. The Town of Southold hereby elects to provide all of its eligible employees with a Retirement Incentive Program authorized by Chapter 105, Laws of 2010.

2. The commencement date of the Retirement Incentive Program shall be October 1, 2010.

3. The open period during which eligible employees may retire and receive the additional retirement benefits shall be 90 days in length and shall end on December 29, 2010.

4. The actuarial present value of the additional retirement benefits payable pursuant to the provisions of this Local Law shall be paid as one lump sum, or in five annual installments. The amount of the annual payment shall be determined by the Actuary of the New York State and Local Employees’ Retirement System, and it shall be paid by the Town of Southold for each employee who receives the retirement benefits payable under this Local Law.

III. SEVERABILITY

If any clause, sentence, paragraph, section, or part of this Local Law shall be adjudged by any court of competent jurisdiction to be invalid, the judgment shall not affect the validity of this law as a whole or any part thereof other than the part so decided to be unconstitutional or invalid.

IV. EFFECTIVE DATE

This Local Law shall take effect immediately upon filing with the Secretary of State as provided by law.
