DA drops case against ex-cop accused of beating hunter

Saying the forensic evidence did not support the charge, the Suffolk District Attorney’s office has dismissed the felony assault charge against former county police officer Jon Ferris, who was arrested in a field behind his Mattituck home in January and charged with beating an upstate hunter with his own shotun after the man had shot and killed Mr. Ferris’s dog.

A second and lesser charge against Mr. Ferris,  illegally feeding deer, is scheduled for trial in Southold Justice Court on June 6.

In a statement issued Friday afternoon, Robert Clifford, a spokesman for District Attorney Tom Spota, said the decision to drop the assault case was based on “credibility issues.”

The hunter, Daniel Lamphere of Rennsaeler, N.Y., “gave conflicting accounts of the incident which were not supported by the forensic evidence,” Mr. Clifford said. “This office determined this case could not be proven beyond a reasonable doubt.”

That decision “is unbelievable and should be investigated,” said George Duell of East Berne, N.Y., Mr. Lamphere’s hunting partner that day.

“I can’t believe that a man could beat another man almost to death and get away with it,” he said. “Forensic evidence? It’s there. He split his head wide open.”

Mr. Duell charged that Mr. Ferris received preferential treatment because of his law enforcement background.

“Because this guy was a cop he walked,” he said. “He must have a lot of pull down there.”

Mr. Lamphere was deer hunting south of the Farmveu community on Jan. 26 when he said he was approached by three dogs. He managed to shoo two away but claims the third lunged at him. He fired a single shot at the animal, a German shepherd named Bear, killing it.

He told police that Mr. Ferris, the dog’s owner then came up to him with a pistol drawn, wrestled the shotgun from him and struck him multiple times on the head with the butt stock.

The Mattituck Fire Department rescue squad brought the 63-year-old Mr. Lamphere to Peconic Bay Medical Center, where ER doctors used 12 staples to close the wounds.

“I was struck seven or eight times,” Mr. Lamphere told The Suffolk Times at the time. “It was a nightmare.”

The DA’s office has not ended its prosecution against Mr. Lamphere, who was charged in April with a misdemeanor count of fourth-degree criminal possession of a weapon. A conviction carries up to a year in jail. As a convicted felon, it is unlawful for Mr. Lamphere to possess firearms. In 1994 he served jail time on an attempted drug possession. conviction.

He was also charged by the state Department of Environmental Conservation with firing a weapon within 500 feet of an occupied dwelling and hunting without the landowner’s permission.

  • WOW!!! What a DIRTY little community we live in.How safe and protected can anyone feel as a victim whether you live here or visit here. Cops,Ex-cops,lawyers and even the District Attorney. A dog was killed,but a dog is only as good as its owner and the owner tried to kill a human being. If the credibility of the victim determined this dismissal of violence than we can only assume that if the Gilgo beach seriel killer is caught,The charges will be dismissed due to the fact that 1. He is presumed to be ex-law enforcement and 2. The credibility of the victims(since these poor girls were prostitutes) How disqusting and scary.

You should know what you read isnt always the truthbetold.He was not a drug dealer,There was no manslaughter,it was a missdemeanor when he was a kid that never was changed on his record,and he never robbed anyone. wrong place,wrong time.No one ever said the dog was shot broadside,it was shot in the back leg while in flight of attack,so if the dog could attack sideways he should have been in the circus not attacking people in the woods.Ferris on the other hand may not have been convicted of a violent felony,but in fact is.The scary part is that he just keeps being able to terrorize his community and with an arms licence,Thank you Mr.D.A.   • Lets not forget Jon shot an innocent kid,a few years ago, all in the of justice- that too is public records. I almost forgot, he got away with that too. I did not forget he was trying to pick up a women in a bar and got in a fight with her spouse, while he was off duty, and lied and said he was on duty, since he hurt his hand beating the spouse. Now the tax payers are paying for this idiot’s rage and he is colloecting over $100K a year to sit home and sell guns and torment the public!

  • I heard that the reason it took so long to dissmiss the charges was because the DA wanted to be absolutely sure that the entire matter was fully investigated.(Just to avaoid the phoney conspiracy posts that are being written by Duell) Lamphere lied about that dog attacking him to stay out of trouble. All the evidence that was collected proved that it could not have happened the way lamphere stated at all. Ferris was arrested because he admitted striking Lamphere but it took a full investigation to prove his side of the story. So in the end Good Guy retired cop-1 Dirtbag convicted Manslaughter/Drug Dealer Dog murderer -0
    Oh by the way No one mentioned that Lamphere was also arrested arrested again for a burglary he committed only trhee days before he was down here hiding out in a corrections officer Frank Meles house.

The only reason he didnt kill Lamphere is becouse he thought Lamphere was already dead after beating him so badly.Lamphere layed holding his breath while ferris checked him to see if he was breathing on numberous occations before calling the cop friends.

  • The reason it took so long was because the DA sat on to make it look better. The DA is supposed to be finding justice for the victim, Mr.Spota did not even contact the victim or his family with any questions or updates. Mr. Spata also had a job prior to the DA’s office working as a lawyer to help cops and detectives in trouble…This was handled unlawfully by all the so called law people. NICE PLACE!

I don’t think that the Ex-cop should have gotten off scott free, but I can understand his anger and his actions, although quite a bit excessive in my opinion. I definitely think had the guy not been an ex-cop the outcome would have been entirly different.
